The Residences at Queens Marque Limited (“The Residences”) and Duggers Men’s Wear Limited (“Duggers”) (collectively the “Contest Sponsor”) is offering the Contest to recipients of the Swipe to Win Card. Each “Swipe to Win Card” is unique and only one of the created Swipe to Win Cards will contain the Prize-winning information. 

Swipe to Win Cards will be distributed by mail to Duggers’ clientele identified on their mailing list. If an individual has not received a Swipe to Win Card during mail distribution, the individual may obtain a Swipe to Win Card by following the instructions in Section 4B.  The number of Contest entrants is limited by the number of Swipe to Win Cards produced, which has been limited at 1,500.  There is one prize available of a $2,500 CAD gift card for Duggers, which has no equivalent cash value (the “Prize”).  Odds of winning are 1 in 1,500. 


The Contest is open to residents of Nova Scotia who are 18 years of age or older.  Persons in the following categories are not eligible to participate in the Contest or win the Prize: (a) any person who on or after April 1, 2019 was or is an employee, director, or officer of any of the Contest Sponsors; (b) any person engaged in the development production or distribution of materials for the Contest, including employees of Revolve Marketing; (c) any person who is or purports to be an immediate family member of or who resides or is domiciled in the same residence as any person in the preceding categories.

 In these Rules, a person who is eligible to enter the Contest is called an “Eligible Person”.


The contest period begins on Monday April 29, 2019 at 12:00 noon Atlantic Daylight Time and ends at 12:00 noon on Saturday June 29, 2019 (the “Contest Period”)


A.     An Eligible Person who has received a Swipe to Win Card may participate in the Contest by scheduling a private viewing of the leasing centre for The Residences at Queen’s Marque by booking the same at www.queensmarque.ca.  A card reader is located onsite.  The Eligible Person can scan their Swipe to Win Card at the leasing centre to determine if their Swipe to Win Card is the winning card.  If for any reason, whether mechanical, technical or due to human error or omission, the Swipe to Win Card cannot be read during the visit the Eligible Person can send their card number and Ackroo ID located on the back of their card to info@queensmarque.ca.  Such Eligible Persons will receive an e-mail reply advising them if their Swipe to Win Card is the winning card.[VJ1] [CM2] 

B.     Any Eligible Person who has not received a Swipe to Win card during the initial mail distribution may contact info@queensmarque.ca to receive a Swipe to Win Card.  Such individuals will be required to provide the name, address and e-mail address with their request for a Swipe to Win Card.  There are only 1500 Swipe to Win Cards produced.  When all of the Swipe to Win Cards have been distributed, no further cards will be created and individuals will not be able to obtain a Swipe to Win Card through this e-mail request mechanism.


There are 1500 Swipe to Win Cards produced.  Odds of Winning are 1 in 1500.  Once the winning Swipe to Win Card has been identified through the winner notification process outlined in Section 6 of these Rules, the odds of winning are reduced to zero.


There is only one potential winning Swipe to Win Card.  An Eligible Person who swipes their Swipe to Win Card at the leasing centre will know automatically if they are the “Eligible Contest Winner”.  An Eligible Person who submits their Swipe to Win Card detail through email will be advised within two (2) business days if they are the “Eligible Contest Winner”. The Eligible Contest Winner will be required to correctly answer a skill testing question without any assistance [VJ3] and execute a Declaration and Release [VJ4] which contains among other things a release of liability and a publicity release.  If the Contest Sponsor finds that the Eligible Contest Winner has properly submitted the Declaration and Release and that the skill testing question has been properly answered without assistance then the Eligible Contest Winner will be declared the winner of the Prize (the “Contest Winner”).  The Contest Sponsor will contact the Contest Winner to arrange delivery of the Prize within two (2) week of determination Contest Winner status.

If the Eligible Contest Winner fails to correctly answer the skill testing question without assistance or fails to properly execute the Declaration and Release, then the Eligible Contest Winner will be disqualified from the Contest and will not receive the Prize.

In this case, a name will be drawn at random on July 2, 2019  from the Eligible Persons who have attended the leasing centre and swiped their Swipe to Win Cards or who have had their cards checked through the online process outlined in Section 4A (the “Random Winner”).  The process described above will apply to the Random Winner.  This process will continue until an eligible Contest Winner or Random Winner is declared the Contest Winner. 

Any potential Prize winner who does not qualify for receipt of the Prize based on the conditions outlined herein, will not have any claim against the Contest Sponsor or against any other firm or corporation in respect of the Prize, the Contest or any matter related to the Contest.


Each participant acknowledges and agrees that all decisions of the Contest Sponsors are and shall be final, binding and conclusive in all matters relating to the Contest. Each participant acknowledges and agrees that all decisions of the Contest Sponsors are and shall be final, binding and conclusive in all matters relating to the Contest. Each participant is solely responsible for ensuring that they have complied with the conditions and requirements contained in these Rules.

The Contest Sponsors are not responsible for a) incomplete, misdirected, late, lost , damaged, stolen or non-delivered mail or electronic communications whether caused by the Contest Sponsors, postal or courier services, wireless carriers, internet service providers or unauthorized human intervention b) technical difficulties or failures of any kind; c) any errors, omissions or failures of any kind; or d) any incorrect or inaccurate information.


Subject to any approval of authorities having jurisdiction which may be required, the Contest Sponsor reserves the right to at any time and without prior notice, terminate the Contest in whole or in part or to modify, suspend or extend the Contest.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity and enforceability of any other provision. In the event that any provision is found by a court of competent jurisdiction to be invalid, the offending provision shall be struck and these Rules read without reference to the offending provision.

These Rules cannot be amended in any way except in writing by a duly authorized representative of the Contest Sponsor

This Contest and the Rules shall be governed and construed in accordance with the laws of the province of Nova Scotia and the laws of Canada applicable therein.

Except as otherwise contemplated in the Rules, personal information collected by the Contest Sponsor may be used by the Contest Sponsor for its marketing purposes but shall not be shared with or disclosed to any third parties without the participants consent.
